6:30 our time, a live report from the vatican with an inside look at the conclave and what's in store during this afternoon's voting session. and, of course, the moment a decision is reached, we will be bringing it to you live here on nbc bay area. 6:02. new details on a morgan hill police investigation of child endangerment at a preschool. today, the santa clara county district attorney could decide on charges against a former teacher, accused of spiking children's drinks with a sleep aid. "today in the bay's" marla tellez joins us with more information on this investigation. gd morning, marla. >> reporter: good morning, laura. that alleged incident happened right here at the kiddie academy. it is set to open its doors at 6:30. the big questions to be answered still, did the questions actually drink the spiked water? number two, did this happen on more than one occasion? morgan hill police say that 59-year-old deborah gratz admits

she put somonex, the popular sleep aid, in several of the sippy cups. the tampered cups were taken away, they say, before the kids could drink from them. police are investigating both statements much deeper. gratz, who taught here for five years, looked after ten 1 to 2-year-olds. they did find some evidence at her home in hollizter, but wouldn't say what that evidence is. parents are shocked, concerned and horrified, especially one mother whose 2-year-old son suffers from epilepsy and he has been under gratz's care for several months. >> i would never picture anybody doing this to any kid. >> as a parent you have this trust which you not only drop off your kids, which is difficult enough, with somebody else to take care of but then that trust to be just crumpled and -- yeah. very disheartening. >> reporter: police say gratz was arrested and booked on one count of felony and misdemeanor

child endangerment charges. the district attorney's office could formally file charges and gratz could be arraigned as soon as today. marla tellez, "today in the bay." along with that, just a shocking story there, outraged parents now have their say at a news conference -- after the news at a pleasantton preschool teacher may have tied up a 2-year-old in her care. >> people were highly frustrated and there was raised voices, yeye yes. >> center point preschool held a clo closed-door meeting with parents just last night. former employee is accused of taping a toddler's hands and feet for not settling down for a nap. the state has barred ca krchcag from working in child care in california and could soon be in court to face charges. center point says it will close on friday for three days of

intensive employee training. it will then reopen on wednesday. police asking for the public's help to catch two purse snatchers in the south bay. police say the victim and the two suspects seen in these photos got off a light rail train station. the suspect in his 20s punched and kicked the woman until she fell to the ground. th they then took off on bikes. the robbery happened in early february. software engineer accused of killing a man in a case of road ra rage. colt holbrook accused of stabbing a man. he says he stabbed the man in self defense because the man reportedly knocked him to the ground and then charged at him. holbrook claims the man cut him out in traffic several times

before that fight. christina loren is here to check that forecast. a lot of people anticipating great weather today. >> i bet you at least one will complain it's too warm out there. warmest day of the year so far. yesterday was the warmest day of the year so far only to be trumped by today. temperatures will peak today, we have mid 80s in some cases. fog up in san jose. not a lot to report right there. 10 miles visibility reported at the surface. as you head up the east shore, watch out. thick pockets really settling in now. take it easy out there. up in santa rosa and concord as well, reportsf less than a quarter mile visibility. when it comes to that fog, we'll be tracking it for you all morning long. future cast at 8:00 am. mostly cloudy at that point. we stop that clock for you again, getting into 11:00 am. nice, clear conditions. as we meet back here for our midday broadcast. we'll be tracking that heat wave. let you know if you're on track to breaking records in your

smith is live at san francisco state university. she is live with all the details. good morning, christie. >> reporter: good morning, jon. there are a lot of benefits to this. right now the courses that students need to graduate are over-enrolled and hard to come by. having online courses could make them more readily available. in some cases those online courses are much cheaper or even free. san jose state, for instance, offers massive open online courses for academic credit. started that recently in a pilot program. one popular online course costs just $150 when in a traditional classroom, just the book would be about that much. today, state senator steinberg will introduce a bill requiring public colleges and universities in california to offer online courses for academic credit, even though it's taught by private companies, not necessarily the university. governor jerry brown has been a big supporter of online education as a way of reducing costs.

so, some professors worry that the online education system overall isn't properly vetted. the numbers, though, are eye opening. according to steinberg, in the 112 community colleges, each had about 7,000 students on waiting lists and across the state's university system, only about 16% of the students graduate in just four years. in part, because of the cost but also because the courses they need to graduate are just hard to get. by the way, we are told it is very likely this bill is expected to pass. reporting live in san francisco, christie smith, "today in the bay." meantime, students at uc berkeley want their voices to be heard on city council. the student association will announce this morning a proposal to draw a student district for the city. so the student community can have a dedicated voice. the students will hold a rally at 9:30 this morning on the steps of city hall. time is 6:13. time to get you caught

watched that raid on osama bin laden unfold. scott mcgrew, sign of just how serious they're taking the threat. >> the white house picks the situation room. i think that's a signal, for sure. the president will discuss both chinese attacks and the recent hack attacks that targeted his own wife. several famous names saw their personal information posted to the internet yesterday, including mrs. obama. what we don't know at this hour is specifically who the invited guests are. only that they are cyber security ceos. on monday, the u.s. took the most serious step yet when the national security adviser specifically called out china, not just blaming the country for hacking, but demanding the leadership there do something about it. new this morning, ucla anderson forecast calling for continued growth in california as we go through some of the slowest recovery since the recession, since the second world war. california housing and auto

>> spectacular. this is "today in the bay." >> announcer: from nbc bay area this is "today in the bay." dwood good wednesday morning. i'm jon kelley. >> and i'm laura garcia-cannon. next leader of the catholic church still waiting in the wings this morning. hours ago, plaque smoke poured out of the chimney at the sistine chapel, signaling the new pope still has not been choech. not as dense as yesterday's thick black smoke, leaving a lot of people wondering if the pope had actually been elected. it will be white smoke we see when the new pope is elected. big screen on st. peter's square. what was the reaction like? >> reporter: well, not the type of eruption as you would imagine

if we had seen white smoke. there was a little confusion. was it black, white or gray? apparently they changed the chemicals to prevent this type of thing happening. because we did not hear the bells and because we did not get word there was a new pope, we determined that it was black smoke, which means they're coming back this afternoon. cardinals now back with two more votes scheduled for this afternoon. if they don't elect a pope, when we take a look at the chimney after the first vote we won't see anything. it will be the last one of the day when we finally get another smoke signal on whether or not they've made a decision. short time ago, we got a briefing, an update from the vatican. they say they were surprised themselves at the number of people in st. peter's square, watching this yesterday. they also confirmed for us that the pope, former pope benedict himself was watching the mass yesterday. he was watching the proceeding into the sistine chap.

hitting 72 degrees. now we're on comet watch. tanstar will be visible as we head throughout this evening. what you want to do, best viewing time will be 25 to 40 minutes after sunset, which occurs at 7:14. lock to the west near the moon. after the sun sets, you will vaguely be able to see this comet. we've already had crazy reports of people capturing pictures and giving us updates on this comet. we'll be able to see it through the 24th of this month. our own shining star, mike inouye. >> oh, thank you, christina. not bad. looking over to our view at the bay bridge toll plaza, i might see -- not a comet, no. motorcycle streaking through the fog. metering lights on the backup and slower drive because of this very thick fog traveling over to the bay bridge, through the bay bridge. the map, the entire maze in the approach. orange overlay across our entire

east bay, fog and low clouds throughout. this is an issue for highway 24. warren freeway, piedmont, al media, northbound 880 around 5th, a stalled out big rig blocking one lane. this could be a major factor. slowing from foothill boulevard all the way up in to downtown. lower visibility. can't use our camera and also the one lane blocked. this could be an issue toward the morning commute. i'll track trait. farther south, view from 880 to 92, looking westbound. taillights you can sey good steady flow of traffic. visibility limited. be sure you lower the speeds approaching as well. down in the south bay, very different case for visibility. 101 north of 680. very smooth, easy flow of traffic. we'll check out 87 and the rest of your freeways coming up.

police are searching for a man who robbed a woman at knifepoint before sexually assaulting her. glass slipper inn saturday night. the suspect found the woman's advertisement for massage online. the assailant trying to rob the woman's associate on his way out. the victims describe him as an asian man in his 30s or 40s, medium build, between 5'5" and 5'9", wearing blue jeans and a brown hooded sweatshirt. this morning, a castro valley man facing drug charges after sheriff's deputies found a reptile at his home guarding pot. they found 3,400 pounds of pot and also a five-foot alligator named, are you ready for this, mr. teeth? he was working, fwargd that stash. investigators say the animal was actually malnourished and seriously ill.

it eventually died the next day at the oakland zoo's hospital. no animal cruelty charges have been filed in this case. new details about a restaurant rebuilding in berkeley after a fire last week. moving back its opening date till at least march 30g9, according to a note on its website. the restaurant previously said it would cancel all reservations through march 23rd. new video of the restaurant where construction is already under way to repair the front porch destroyed in that fire. the berkeley fire department says it looks like an electrical problem caused last friday's fire. the time now is 6:37. still ahead, bay area link to a fiery explosion on the bayou. new video as a tug boat turns into a fireball. and new details about this scary investigation into the crash. plus will charges be filed over sleeping pills placed into preschool sippy cups? what we are learning about the

we have new video to show you of that fire aftermath after a tug boat pushing a barge strikes a pipeline in the bayou south of new orleans. that fire burning out there,

burned for hours, leaving four people injured, including the captain of the tug boat who is reportedly severely burned. now the coast guard is dealing with the reports of oil out in that water. we understand that pipeline is owned by chevron, which is based in san ramon. polarizing rape trial begins in steubenville, ohio. two high school football players are accused of raping a drunk 16-year-old girl during a night of partying last summer. some in steubenville have criticized prosecutors for not charging three other boys who were witness to the alleged attack. some of them took cell phone pictures and video. sleeping aids in sippy cups. why the allegations have not yet led to charges against a daycare teacher. a sink hole in one, unexpected hazard on a course that swallowed a golfer into the

at 6:44, live look at the vatican where, just a short time ago, black smoke poured out from the chimney at the sistine chapel. that means no pope has been chosen. we're all waiting for the white smoke and we'll, of course, have more details on what is next for the conclave in just minutes. right now, new details this morning on a child endangerment case going on in morgan hill. santa clara county district attorney may decide today on charges for a daycare worker accused of putting sleeping pills into children's sippy cups. wgs today in the bay's" marla tellez is live with an update on the ongoing investigation. good morning. >> reporter: jon, good morning. the kiddie academy isn't used to this kind of exposure. it's part of a nationwide chain that's been around 30 years. certainly has some experience under its belt. the one here where this allegedly happened opened its doors moments ago. a handful of kids dropped off

their kids without hesitation. they didn't seem phased by this. they didn't want to comment on camera. they told me they just heard about this, yet they're okay to drop their children off here. after having to fire deborah gratz, they're doing damage control. 59-year-old teacher admits she put sominex, a popular sleep medication in several children's sippy cups last week. she says it was the only time that happened and the academy says tampered cups were taken away before the kid koss drink from them but morgan hill police are investigating both statements much deeper. gratz, who taught here for five years, looked after ten 1 to 2-year-olds. police say they did find evidence at her home in hollister, but won't say what that evidence is. at least one mother says she still has faith in this daycare. >> i think it's just the particular one incident. andy do, you know, believe in his teachers doing a good thing and, you know, that they're

taking care of him. i trust them. >> i would never picture anybody do this to any kid. >> reporter: kiddie academy released a statement, saying in part "we are fully cooperating with authorities in this case. we take this matter seriously." back here live, you can see posted right above their door, kiddie academy was voted best child care learning center in morgan hill in 2011. as for gratz, her acase is now n the hands of the santa clara district attorney. that office could file charges against her as soon as today. i'm marla tellez, "today in the bay." patrols are being stepped up around bell haven elementary, on the lookout for a man accused of approaching three young girls on their way to school. the men tried to ask the girls a question but they kept walking. last seen driving a white colored work van. the suspect may be the same man wanted for exposing himself to a young girl in the same area last month.

also new this morning, police stepping up patrols in foothills high school after finding threatening graffiti. the graffiti includes a threat toward the school shall the principal says. that threat was apparently written in marker on the walls of one of the girls' bathrooms. so far, no word yet on who wrote that message. there is an anonymous tip line that is set up if you happen to know any information. you're asked to please call pleasanton police. new this morning, pleasanton police are releasing a photo of the man they say robbed the west bank branch tuesday morning. the man handed the teller a note saying he was robbing the bank. then ran away with stolen cash. city of los altos now finds itself the victim of five armed robberies in five weeks.

public. they prayed before that in the sistine chapel to begin the first round of voting for the day. they are breaking for lunch, will return back to the chapel around 11:00 our time to begin a second round of voting. governor jerry brown expected to attend the uc board of regions meetings. ucsf mission bay campus. sherry lansing expected to open this meeting. today, california will introduce legislation mandating allstate schools except online course credit for students who are locked out of crowded classes on campus. because the courses they need are overbooked. to extend academic credit for online courses. take a look at what we're going to show you here, according to the numbers of the state's 112 xhount colleges. each had at least 7,000 enrolled students on waiting lists for required courses. only 16% of students are graduating within four years. that, according to california state senator darryl steinberg, who will introduce this bill today. students would get credit for online courses not just taught by the university but another company. professors are worried that the courses may not be properly vetted. san jose university have already moved ahead with online programs, started recently with

a private program. the benefit? unlimited enroll and could be a lot cheaper. the cost for one course there ran $150 online. in a traditional class just the book could cost that much. the bill? well, it is expected to ultimately pass. reporting live in san francisco, christie smith, "today in the bay." musicians with the san francisco symphony using team rivalry to try to get management to play ball during labor negotiations. string quartet played for 30 minutes in the city hall rotunda wearing dodgers caps. the musicians say they are paid thousands less than other musicians in other cities, including the los angeles philharmonic. >> i think it's okay to call this an official hot streak, eight straight days for the dow.

neither up nor down, right about where it started, laura. you're right. tuesday there was this same behavior early. then we saw a jump shot at the buzzer to gain enough to set one more record. it could happen again today. dow industrials are down a mere 25 points. apple down another 50 cents this morning. netflix always a volatile stock up. you will soon be able to like movies from netflix on facebook, a connection between netflix and facebook has been prohibited until now because of a very old law forbidding video companies from revealing what customers rent. that dates back to a supreme court decision. this has now changed. you will be able to see on netflix what movies your friends like, what you like. not yet on facebook yet.
